Our neighbor's attorney sent us a video and audio recording of us on?

Im unclear of the facts, but it sounds like you are saying that a member of the Bar sent you a demand letter that you cease and desist from trespassing with the threat that she would seek a restraining order if you fail to comply, but, in fact, the video proves that you were on your property at the time and you have a survey to prove it. If those are the facts, you could ignore it and wait for the petition for a restraining order. The lawyer is required to check her facts before filing that in any state in which I practice. If the demand letter asks you to respond if there are any false facts in the letter, the lawyer can use that to protect against sanctions or a malicious process lawsuit, but you are not required to answer the letter. If you check that the attorney is really a licensed member of the Bar, however, you may want to let that lawyer know through a lawyer or as briefly as possible with as little contact and as few random admissions as possible that the video shows you to be on your own property. A demand letter is a part of the investigation process, so lawyers can provide them to clients fairly cheaply, because they dont do much investigating before they send them. Once the lawyer knows that you were on your property, the theory may change to nuisance or something similar based on your state laws, but it wont be trespass to property. In any event, you should stay off your neighbors property. He doesnt like you, and you are on notice that you arent invited. You can post your property or send him a notice to stay off your property, too. Perhaps tall fences make for good neighbors
